Eligibility
We only permit individuals who are at least 18 years old and can form legally
binding contracts with us to use the Services. However, even non-adults deserve
fantastic eyewear, so if you are under 18 years old and would like to use the
Services, you can, but only if a parent or legal guardian who is at least 18
years old supervises you. In all cases, the adult would be the user and is
responsible for any and all activity.
Also, you can only use or receive the Services to the extent the laws of your
jurisdiction or the Hong Kong government do not bar you from doing so. Please
make sure these Terms are in compliance with all laws, rules and regulations
that apply to you.
Your use of the Services means you
represent and warrant that you meet all eligibility requirements we outline in
these Terms. We may still refuse to let certain people access or use the
Services. We may also change our eligibility criteria.
We offer the Services only for personal,
noncommercial use, and not for the use or benefit of any third party.
Privacy
Our Privacy Policy details how we collect and use your information. Please
review it if you would like to know more about how we collect, use, and treat
your information.
Account Registration
You can maneuver most of the Services without creating a user account
(”Account”). Other features, however, may require you to create an Account. If
you create an Account, you are solely responsible for any activity that occurs
through your Account. In order for us to provide you the best possible service,
you agree to provide us with complete, accurate, and updated information for
your Account at all times. If any information is incorrect or outdated, it can
lead to errors or delays, for which we will not be responsible.
You should not, however, share your Account information. You may never use
another person’s Account or registration information for the Services without
permission. Similarly, no one else should be able to use your Account without
permission. You are solely responsible for keeping your Account and Account
password secure and for any consequence resulting from your failure to do so.
You should never publish, distribute, or post login information for your
Account.

Home Try-On. Three Frames for Three Days
Mono Eyewear offers a three-day Home Try On service to let you choose your best
fit frames at home for free! You may choose three frames (with non-prescription
lenses) to try on at home for three days. When you pick frames from our Home
Try-On program, we will verify the credit card information, which may
pre-authorize a charge on the credit card you provide to us. This charge is
only for security purposes and should typically disappear within about 48 hours
of you placing the Home Try On order, although the exact timing will depend on
your bank. When you use our Home Try On service, you agree to return all Home
Try On frames to us in their original condition within the three days, using
the pre-paid return packaging we provide. If any of the frames have not been
returned, or the frames are returned damaged, we will charge your credit card
for the full amount of each pair of frames that are missing or damaged ($468
per each frame). That means this charge applies to frames that you decided to
keep or are lost, stolen or damaged. By submitting your Home Try On order, you
authorize Mono Eyewear to charge your card for the full retail price of each
frame as displayed on our site, if you do not return your Home Try On frames
according to the guidelines in this section. If you need an extra day or two,
please just send us an email at help@mneyewear.com.
In order to avoid being charged, your Home Try On return package will need to
be postmarked (on its way back to Mono Eyewear) by the third full day after
delivery. If your Home Try On period ends on a weekend or holiday, just drop
the return package in the mail on the next available day. Remember, if you need
an extra day or two, just send us an email at help@mneyewear.com.
If you decide to purchase any of the frames you tried on, you may do so by
placing an order through the Services. For prescription eyewear, we will also
need any required, valid prescription information when you place your order.

Getting Your Mono Eyewear
1. Select Your Frames: Mono Eyewear sells optical frames that can have either
prescription or non-prescription lenses. If you want to order an optical frame,
select the desired frame and click the “Add to Cart” button to add it to your
order.
2. Provide Your Prescription: If you are purchasing prescription eyewear, you
can provide your prescription information by the following methods:
• there is a blank in the order page which allows you to enter your
prescription information
• providing it after you complete your transaction online by email at
help@mneyewear.com along with your name, order and the order number.
If your prescription or order information is incomplete, we may need to take
additional measures to track down current information, which could mean you
have to wait longer for your glasses. Your prescription should be valid to
avoid wearing uncomfortably.
For people who have high index
prescription, we are sorry that we are now unavailable to provide high index
lens option. If your prescription has a sphere greater than +4.00 or less than
-4.00, you may need to obtain high index lenses from other optical shops.
3. Pupillary Distance Measurement: We will also need your Pupillary Distance
(”PD”) (fancy words to describe the distance between your pupils) to fill your
order. If your PD is not on your prescription, we have provided
self-measurement tools online in our website, but there is always a risk that
your measurement is not as accurate as one performed by a trained eye care
professional. By using our tools, you acknowledge that risk and agree that we
will not be responsible for any inaccuracies in your PD.
4. Delivery Information: Please type your name, address, and telephone number
to order for your Mono Eyewear purchase. We are now only available Hong Kong
buyers. All orders are shipped to Hong Kong for free. Your eyewear will be
delivered to your home within 7 days. If you need your eyewear sooner or just
don’t want to wait, please contact us at help@mneyewear.com before placing your
order to determine whether or not we will be able to expedite shipping.
5. Payment: After you have made your eyewear selections and provided your
shipping information, you will see a prompt for your payment details. You can
pay for your order by credit cards or by paypal. By entering your payment
information and submitting your order, you authorize us to charge the amount of
the order to your selected payment option.
6. Checking Order Status: We will send you an email confirmation with tracking
information once your eyewear is on its way to you. You can also track your
order through SF Express website by typing the reference number of your order.

7. Changing or Cancelling an Order: If you would like to change or cancel an
order, contact us at help@mneyewear.com with the subject line “Change/Cancel
Order.” If we have already shipped the order, we will provide you with a
prepaid return shipping label so that you can still return the glasses after
you receive them. We will refund the order after receiving your return request.

subject line “Change/Cancel Order.” We are unable to make the requested change
or cancellation, if the products are already shipped or the prescribed lenses
are ready.
8. Risk of Loss: The risk of loss and
title for all products you order passes to you upon our delivery to the carrier
(such as S.F. Express or FedEx).
9. Returns and Exchanges; Lens
Replacement: You have 7 days to return or exchange your Mono eyewear from the
day you receive them. In order to process your return or exchange request,
we'll need you to send your glasses, the extras you received (such as cases and
cleaning cloths), and your original invoice back to us. Please note that we can
only accept items that are returned in their original condition. If you would
like to make a return or exchange, please contact us via email or live chat to
get started with your return or exchange. We'll provide a free return shipping
label and instructions for sending your item(s) back to us. Sale items are excluded for refund and/or exchange. You must use our original
packaging to ship your items back to us.
For returns, we'll start processing your
request as soon as we receive your items. With our 7-day guarantee, we'll
credit you back for the full amount of your returned items as long as we
receive them just as we sent them to you. Your items will be refunded to the
original form of payment, and we'll send you an email when your return is
complete. Please keep in mind that refunds normally take 5-7 business days to
appear on your credit card statement.
For exchanges, we'll process your request with a store credit so you can pick
out a new pair of glasses that better suits you after we received your exchange
product in new condition.
Our customer service team will inspect all items received for returns and exchanges.
We are only able to process returns and exchanges for items that do not show
any signs of use.
Please note: We currently do not provide
any returns or exchanges for prescribed glasses.
If your items didn't arrive in perfect condition, please contact us via email
or live chat immediately. We would like to help!
Mono Eyewear Limited is not liable for
any discomfort in wearing our glasses.
10. Access to your Prescription: We keep
your prescription on file for some time after you order your glasses, and we
make that information available to you upon request. We will respond to your
request as quickly as possible, but please allow us two or three days to
retrieve older prescriptions.
11. Insurance: Please click here for
information on payment and insurance.
12. Purchase Limits: We do not authorize
the purchase of commercial quantities of our glasses, and we may place limits
on purchases. We may also, among other things, restrict orders placed by or
under the same customer account, the same credit card, and/or orders that use
the same billing and/or shipping address. We reserve the right to limit, cancel
or prohibit orders that, in our judgment, appear to be placed in violation of
this policy. We further reserve the right to cease doing business with customers
who violate this policy and any other parts of our Terms and Conditions.
13. Language: Presently, our order
process only supports the English language.
Intellectual Property
You do not get any of our intellectual
property upon purchasing our glasses. All of the content that appears on the
Services, including without limitation all designs, illustrations, icons,
photographs, video clips and written materials, as well as the compilation of
the website, Services, and other materials, are the exclusive property of Mono
Eyewear or our licensors and is protected by Hong Kong and international
copyright laws. All trademarks, service marks, and trade names that appear on
the Services and the overall “look and feel” of the Site and Services
(collectively the “Marks”) are proprietary to Mono Eyewear, or the respective
owners of such Marks. You may not display, reproduce, or otherwise use the
content or materials on the Services, including the Marks, without first
receiving written consent from us. You may not remove or otherwise modify any
legal or trademark notices from any content we make available through the
Services. Scraping the Services or using other automated or manual means to
take our content without our prior consent is expressly prohibited. Any unauthorized
use of any content or materials on the Services is strictly prohibited and
violates copyright, trademark, and/or other intellectual property laws, and/or
the laws of privacy, publicity, and/or communications regulations and statutes.

Limited Licensure
All visitors to the site
www.mneyewear.com are given a limited, non-exclusive, non-sublicensable and
non-transferable license to use (i.e., display locally) the Services solely for
personal, non-commercial, use. This license will allow you to use and enjoy the
benefit of the Services as we provide them, in the manner we permit through
these Terms. This license solely gives you the rights we expressly stated in
this section.
To be clear, however, this license does
not allow you to do any of the following:
- resell or make any commercial use of the Services or any of the
Service content;
- modify, adapt, translate, reverse engineer, decompile, disassemble,
or convert into human readable form any of the Service content not
intended to be so read, including using or directly viewing the underlying

License You Grant to Mono Eyewear
We have the right to areas on the
Services where you post information or communicate with us or other users.
These areas may be in the form of social media posts, bulletin boards, chat
rooms, comment areas, billboards, forums, news groups, postings sections or
similar communications facilities.
However, you will still keep all
ownership or license rights in your User Content (as defined below), including
the right to grant additional licenses to your User Content. There are no
restrictions on your ownership and license rights in your User Content unless
you otherwise agree in writing. However, when you provide your User Content to
us, we need to be able to do certain things with it as described below.
We do not own any of your content,
although by providing content to us, you may grant us a license to use it.
When you submit, distribute, transmit,
or post any communications or any other material to Mono Eyewear (either
through the Services; through our pages on third party sites, such as
Instagram, Twitter and Facebook; or through activities in our stores, such as
when you take pictures in our store. This is collectively “User Content”), you
give us a right and license to use, copy, reproduce, process, adapt, modify,
publish, transmit, display, and distribute your User Content in any and all
media formats or distribution channels. You agree that this license includes
the right for Mono Eyewear to use your User Content to provide, promote, and
improve the Services. You agree that this license is irrevocable,
non-exclusive, perpetual, worldwide, transferable, sublicensable, fully paid,
royalty-free, and will survive termination of your Account. Please note that we
may use User Content without compensation of any kind to you, including if we
use User Content for advertising or promotional purposes.
You also agree that if your User Content
contains any ideas, concepts, know-how, or techniques, we can use the User
Content and anything it contains for any purpose including, but not limited to,
developing, manufacturing, and marketing products.
In addition to giving Mono Eyewear a
license, you also give each user of the Services an irrevocable, non-exclusive,
perpetual, worldwide, transferable, sublicensable, fully paid, and royalty-free
right and license to access your User Content through the Services and to use,
edit, modify, publish, reproduce, distribute, prepare derivative works of,
display, perform, adapt, and promote such submissions, including after any
termination of your Account.
The bottom line is that if you share
something with us, you keep ownership of it and can continue to do anything you
want with it, but you allow us and our other users to use your User Content as
we see fit. If you don’t agree to these conditions, then please don’t provide
the materials to us.
Representations About Content You Submit
When you submit User Content, you
represent and warrant that
- you hold all necessary right, title, and license to such materials
(in other words, you own it or have the right to give it to us);
- that your submission of such materials to Mono Eyewear does not and
will not violate or infringe the rights of any third-parties, including
without limitation, any privacy rights, publicity rights, copyrights,
trademarks, contract rights, or any other intellectual property or
proprietary rights (you didn’t take it from someone else without
permission); and
- all User Content you provide is accurate, complete, up-to-date, and
not misleading.
In addition, any User Content must not
- include any profanity or obscene, indecent, or pornographic material;
- contain any unauthorized or unsolicited advertising, such as spam (no
one likes spam);
- contain software viruses or any other computer codes, files, or
programs that are designed or intended to disrupt, damage, limit, or
interfere with the proper function of any software, hardware, or
telecommunications equipment or to damage or obtain unauthorized access to
any system, data, password, or other information of ours or of any third
party;
- impersonate any person or entity (we like you just the way you are!);
or
- include anyone’s identification documents or sensitive financial
information.
Third-Party Content and User Content
You may see a lot of different content
on the Services. Some of this content will come from other users or third-party
sources. All content, including User Content and third-party content, is the
responsibility of the party that creates it. We do not control or endorse any
User Content or third-party content, and we make no claims or representations
regarding any content we do not create. We may provide links to third-party

data, replacement costs, or any similar damages, whether based in contract,

including, but not limited to, any errors or omissions in any content, or any

Governing Law

by the laws of Hong Kong no matter where you are located.
Severability

and Conditions are invalid, void or unenforceable, that term will be deemed
severable and limited or eliminated to the minimum extent necessary. The
